注:1.若在先申请使用的语言并非欧盟知识产权局的五种官方语言之一(英、德、法、意、西),应官方要求,申请人需在官方设定的期限内一并提交相应的翻译件(翻译件需为欧盟商标申请的第一或第二语言)。

2.《欧盟商标实施条例》(即EUTMIR)生效后,在主张优先权时需要递交的在先申请文件副本不再要求必须是经过认证的在先申请文件副本,而仅要求在先申请文件副本包含和原始申请文件同样的信息并注明了在先申请的申请日。

3.在上述主要信息和材料齐全,且申请费用在受理日起一个月内完成支付的情况下,受理申请日通常即为商标申请日。

欧盟商标申请流程

1.欧盟商标申请准备及查询:提交欧盟商标申请前,商标申请人需要对申请注册的商标进行近似查询,以及是否委托代理机构;

2.提交申请:通过欧盟知识产权局(即EUIIPO)提交商标申请(在线申请或者纸件申请),并缴纳申请费;

3.商标受理及形式审查:官方将审查申请人递交的商标申请是否符合相应的形式要求,如所需的基本信息是否已经齐备,相应的费用是否已经支付。

4.商标实质审查:官方将审查申请人递交的商标申请是否存在绝对的注册障碍。在实质审查过程中,如果存在绝对注册障碍,该欧盟商标申请将部分或全部被驳回。但是,在申请人被允许有机会撤回或修改申请、或提交其陈述意见前,申请不得被驳回。欧盟知识产权局对商标的实质审查并不涉及相对注册障碍,即官方不会审查拟申请的商标是否与他人的在先权利相冲突。

此外,在申请人明确提出请求的前提下,欧盟知识产权局会对可能与申请商标发生冲突的在先欧盟商标或商标申请进行检索。在申请人明确要求并额外付费的情况下,成员国的工业产权局也会对可能与申请商标发生冲突的在先各成员国商标进行检索。

5.商标公布/异议:审查没有发现问题或所发现的问题已经被更正,申请商标就会被公布。在公布后,如果申请商标被发现其因绝对注册障碍而需被驳回,那么驳回的裁定也需要被公布。

在申请商标公告之日起三个月内,如果其他在先商标权人(包含其他商业标识权人)认为公告的申请商标与自己的在先商业标识之间在全部或部分商品或服务上存在混淆危险,则可向欧盟知识产权局提出针对该申请商标在全部或部分商品或服务上的异议。如果异议成功,则欧盟商标申请将在全部或部分商品或服务上被驳回。如果异议失败,则异议请求人的异议请求会被驳回。

6.商标注册:在没有异议或异议请求被驳回的情况下,所申请的欧盟商标将会被注册并公告。

注:1.对于从递交申请到注册总共所需的时间,欧盟知识产权局在没有异议的情况下5个月左右(在符合加快条件的情况下)。

2.对于在欧洲经济区(欧盟全部27个国家,及冰岛、列支敦士登和挪威)内没有住所、主要营业场所或真实且有效的工商业机构的申请人,除递交申请外,其在欧盟知识产权局的所有程序必须由欧盟境内具有资质的代理人代理。

注:1.欧盟商标注册的费用需要在申请之日起一个月内支付。

2.欧盟商标的初始保护期限自申请日起十年。每经过十年都可以进行续展,可以无限期续展。欧盟商标续展必须在商标的有效期之前的六个月内支付续展费。如未在指定期限内续展,有六个月的宽限期,但需支付25%的附加费。

欧盟商标申请注意事项

欧盟商标申请语言的要求

依据欧盟的语言政策,欧盟的官方语言共24种,欧盟知识产权局的官方语言共五种,分别为:英语、德语、法语、意大利语、西班牙语。

依据《欧盟商标条例》第146(1)条的规定,欧盟商标申请人可以使用任何一种欧盟官方语言递交其欧盟商标申请。欧盟商标申请人所选定的申请语言通常被称为欧盟商标申请的第一语言(简称为“第一语言”)。

同时,《欧盟商标条例》第146(3)条规定,欧盟商标申请人在递交其商标申请时,需一并指定适用于该申请的第二语言(简称为“第二语言”),该第二语言必须是欧盟知识产权局的五种官方语言之一。申请人选定第二语言,即表明其同意在该商标申请之后可能出现的异议程序、权利丧失程序和无效程序中可以使用该第二语言作为相应对抗程序的语言。

欧盟商标申请快速通道

欧盟商标申请人提交申请后,符合条件的欧盟商标申请从申请提交到申请公开所需要耗费的时间相比一般申请而言将减少一半甚至更多。

请求欧盟商标快速通道条件:

1.申请人必须在欧洲经济区(EEA)居住,否则必须指定有效的代表;

2.商标只能是文字或者图像等简单的标识;

3.不得在申请中请求国家或欧洲搜索;

4.没有申请优先权,如果需要, 那这个优先权必须是通过欧盟TMVIEW 数据库直接可以引用的标的才可以;

5.商品和服务清单中的所有术语都必须从欧盟投资促进机构以前接受的术语数据库中选择;

6.申请同时缴付官费;

7.如果申请的语言不是欧盟投资促进机构的五种语言之一,申请人应接受办事处从五种接受的语言中选择的第二语言提供的翻译。

注:1.银行转账付款及其相应的交易代码必须在提交申请后九天内到达 EUIPO。此外,EUIPO 将无法保证快速通道处理及时性标准。

2.快速通道无需支付额外的费用,满足上述条件即可申请。

欧盟商标或商标申请转化成员国国内商标

将欧盟商标/商标申请转换为成员国国内商标/商标申请可以有效克服欧盟商标单一性带来的问题,转换后的成员国商标/商标申请可以享有原欧盟商标/商标申请的申请日(在原欧盟商标/商标申请有优先权的情况下,同时可以主张该欧盟商标/商标申请的优先权),从而使得该成员国商标/商标申请在后续异议或无效程序中获得优势。

欧盟商标转化为成员国国内商标的条件:

1.在审查阶段或者异议程序中,欧盟商标申请基于绝对或者相对注册障碍被驳回;

2.欧盟商标申请人撤回其欧盟商标申请;

3.欧盟商标申请由于未在规定期限内缴纳申请费而被视为撤回;

4.已注册欧盟商标因商标权人主动放弃其欧盟商标、欧盟商标保护期限届满而未进行续展、欧盟商标被欧盟知识产权局或欧盟商标法院宣布无效和欧盟商标被欧盟知识产权局或欧盟商标法院宣告权利丧失这四项事由而丧失效力。

注:1.自欧盟商标申请被撤回或欧盟商标丧失效力之日起不可延长的三个月内递交转换申请。

2.欧盟商标/商标申请转换为成员国国内商标/商标申请的费用包括转换申请费和成员国知识工业产权局缴纳的费用。

英国脱欧后对欧盟商标的保护范围的影响

英国脱欧过渡期结束后,欧盟法不再适用于英国,因此原则上,自2021年1月1日开始,欧盟商标和欧盟外观设计的地域保护范围将不再及于英国(包括直布罗陀、海峡群岛和马恩岛以及从属英国领土),而仅及于欧盟的27个成员国。

对于过渡期结束前已注册的欧盟商标的权利人来说,自2021年1月1日开始,其所持有的欧盟商标不再在英国境内作为欧盟商标获得保护效力;同样,对于过渡期结束前尚未完成注册的欧盟商标的权利人来说,其后续获得注册的权利的保护效力的地域范围也不会包括英国。

基于上述理由,在过渡期结束后,欧盟商标法院签发的适用于整个欧盟范围的禁令原则上也不再在英国境内有效。

Note:1.If the first application is made in a language other than one of the five official languages of the EUIPO (English, German, French, Italian and Spanish), the applicant shall, upon official request, submit the corresponding translation (which shall be the first or second procedural language of the EU trademark application) together with the official deadline.

2.With the entry into force of the EU Trademark Implementation Regulation (EUTMIR), it is no longer required that copies of the earlier application documents submitted in order to claim priority should be certified copies of the earlier application documents, but only that copies of the earlier application documents should contain the same information as the original application documents and indicate the date of application of the earlier application.

3.If the above main information and materials are complete and the application fee is paid within one month from the date of acceptance, the date of acceptance of the application is usually the date of trademark application.

Processes

1.EU trademark application preparation and inquiry: before submitting the EU trademark application, the trademark applicant needs to conduct a similar inquiry on the trademark applied for registration, and whether to entrust an agency;

2.Submit the application: Submit the trademark application through EUIIPO and pay the application fee;

3.Trademark acceptance and formal examination: the authorities will examine whether the trademark application submitted by the applicant meets the corresponding formal requirements, such as whether the required basic information is available and whether the corresponding fees have been paid.

4.Substantial examination of trademarks: the authorities will examine the applicants trademark application for whether there is an absolute barrier to registration. In the course of substantive examination, if there is an absolute barrier to registration, the EU trademark application will be rejected in part or in whole.However, the application shall not be dismissed until the applicant has been allowed an opportunity to withdraw or amend the application, or to submit his or her stated views. 

The substantive examination of trademarks by EUIPO does not involve relative registration barriers, that is, the authorities will not examine whether the trademark to be applied conflicts with the prior rights of others. In addition, where the applicant has made an explicit request, EUIPO will search for any prior EU marks or trademark applications that may be in conflict with the applied mark. At the express request of the applicant and at an additional cost, the industrial property office of the member state will also search for the trademarks of the prior member state that may be in conflict with the applied mark.

5.Trademark disclosure/objection: the application is published when the review finds no problems or when the problems found have been corrected. If, after publication, the application for a trademark is found to be rejected because of an absolute barrier to registration, the ruling of rejection shall also be published.

In the application within three months from the date of the announcement of trademarks, if other prior trademark business identity rights (including other people think) announcement prior to apply for the trademark with their own business logo on all or part of the goods or services between the risk of confusion, can to EUIPO to apply for to the trademark on goods or services in whole or in part on dissent. If the objection is successful, the EU trademark application will be rejected for all or part of the goods or services. If the objection fails, the objection requestors objection is dismissed. Any party who is not satisfied with the decision of EUIPO may lodge a written appeal with EUIPO within two months of the service of the decision.

6.Trade mark registration: the applied EU trade mark will be registered and published if there is no objection or the objection request is rejected.

Note: 1. In terms of the total time required from the submission of an application to registration, EUIPO is aiming for around five months without objection (subject to expedited conditions).

2.In the case of an applicant who does not have a domicile, principal place of business or a genuine and valid industrial or commercial establishment in the European Economic Area (all 27 EU countries plus Iceland, Liechtenstein and Norway), all proceedings at EUIPO must be handled by a qualified agent in the EU, except for the submission of the application.

Note:1.Fees for EU trademark registration need to be paid within one month from the date of application.

2.The initial period of protection for EU trademarks is ten years. They can be renewed every ten years, they can be renewed indefinitely. A renewal fee must be paid within six months prior to the period of validity of the trademark. If it is not renewed within the specified period, there will be a six-month grace period subject to a 25% surcharge.

Requirements for the language of the EU trademark application

According to the European Unions language policy, there are 24 official languages in the European Union, and five official languages in the European Intellectual Property Office: English, German, French, Italian and Spanish.

In accordance with article 146 (1) of the EU trademark directive, an applicant for a trademark in the EU may submit its application for a trademark in any of the official languages of the EU. The language of application chosen by the applicant for the EU mark is often referred to as the first language of the EU mark application (referred to as the “first language”).

At the same time, Article 146 (3) of the EU Trademark Regulation stipulates that a trademark applicant in the EU, when submitting its application for a trademark, must specify the second language applicable to the application (referred to as the “second language”), which must be one of the five official languages of the EUIPO. By selecting a second language, the applicant agrees that the second language may be used as the language of the corresponding countermeasure proceedings in the proceedings of objection, loss of rights and invalidation that may occur after the application of the trademark.

Fast track EU trademark application

After EU trademark applicants submit their applications, the time required for eligible EU trademark applications from submission to publication will be reduced by half or more compared to the average application.

Request for EU trademark fast track conditions:

1.Applicants must reside in the European Economic Area (EEA). Otherwise, you must specify a valid representative;

2. Trademarks can only be simple logos such as words or images;

3.no request for EUIPO or national searches;

4.No priority has been claimed. If necessary, the priority must be directly referenced by the EU TMVIEW database;

5.all goods/services must be selected from database of terms accepted by EUIPO;

6.fees paid on filing;

7.If the application is in a language other than one of the five languages of the EU Investment Promotion Agency (English, French, German, Italian and Spanish), the applicant shall receive an interpreter from the Office in the second of the five accepted languages.

Note:1.The bank transfer payment and the corresponding transaction code must reach EUIPO within nine days of the filing of the application. In addition, EUIPO will not be able to guarantee fast-track processing timeliness standards.

2.There is no additional charge for the fast track and you can apply if you meet the above conditions.

EU mark or trademark application for conversion of domestic mark of member state

Converts the EU trademark/trademark application to domestic brand/trademark application can effectively overcome the EU member states trademark singularity problems, the transformed member logo/trademark application can enjoy the original EU trademark/trademark application the application date (in the original EU trademark/trademark application priority, at the same time may avail itself of the EU trademark/trademark application priority). Thereby giving the trademark/trademark application of the member state an advantage in subsequent objection or invalidation proceedings.

Conditions for the conversion of EU trademarks into domestic trademarks of Member States:

1.In the review stage or objection procedure, the EU trademark application is rejected on the basis of absolute or relative barriers to registration;

2.The EU trademark applicant withdraws its EU trademark application;

3.An application for a trademark in the EU is deemed to have been withdrawn if the application fee has not been paid within the prescribed time limit;

4.The registered EU trademark loses its effectiveness because of four reasons: the owner of the trademark gives up the EU trademark on his own initiative, the expiry of the protection period of the EU trademark does not renew it, the EU trademark is declared invalid by the EU Intellectual Property Office or the EU Trademark Court, and the EU trademark is declared forfeited by the EU Intellectual Property Office or the EU Trademark Court.

Note:1. The application for conversion shall be submitted within an unextended period of three months from the date on which the EU trademark application is withdrawn or the EU trademark becomes ineffective.

2. The cost of converting an EU trademark/trademark application into a domestic trademark/trademark application of the Member State includes the conversion application fee and the fees paid by the Intellectual Industry Property Office of the Member State.

Impact of Brexit on the scope of trademark protection in the EU

British Europe after the transition period, the European Union law no longer applies to the UK, so in principle, since January 1, 2021, designs the geographical scope of protection of the trademark and the European Union will no longer and in the UK (including Gibraltar, the channel islands and the isle of man, and affiliate British territory), but only in the eus 27 member states.

For holders of EU marks registered before the end of the transition period, the EU mark held by them will no longer have protection as an EU mark in the United Kingdom from 1 January 2021; Similarly, for those who have not completed the registration of EU trademarks before the end of the transition period, the geographical scope of the protection effect of their subsequent rights to be registered will not include the United Kingdom.

For these reasons, EU-wide injunctions issued by the EU Trade Marks Court will also in principle cease to be valid in the UK after the transition period.
